KAPALI DEVRE KAMERA KAYIT SİSTEMİ İLE ZİYARETÇİLERE İLİŞKİN AYDINLATMA METNİ
Biz Maçka Residences Apartmanı Yönetimi (“Maçka Residences” veya “Bina Yönetimi”) olarak veri sorumlusu sıfatıyla 6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”
veya “Kanun”) ve ilgili mevzuat kapsamında, iş süreçlerinin yerine getirilmesi doğrultusunda Maçka Residences binasında içerisinde bulunan bütün kişilere ait kişisel verileri işliyor, aynı zamanda KVKK’da, KVKK’ya bağlı yürürlüğe konulan ikincil mevzuatta, Kişisel Verileri Koruma Kurulu’nun bağlayıcı nitelikteki kararlarında ve sair mevzuatta belirtilmiş olan teknik ve idari tedbirleri alarak işlediğimiz verilerin korunması için elimizden gelen tüm çabayı gösteriyoruz.
İşbu metin ile, veri sorumlusu sıfatıyla KVKK’nın 10. maddesinde belirtilen aydınlatma yükümlülüğünü yerine getirdiğimizi ispatlamakta ve böylece sizleri kişisel verilerinizin işlenme süreçleri hakkında detaylıca bilgilendirmeyi hedeflemekteyiz.
Maçka Residences binasında bulunan kapalı devre kamera kayıt sistemleri (“CCTV”) ve tarafımıza ilettiğiniz kimlik belgeniz vasıtasıyla tamamen otomatik olan yollarla elde ettiğimiz Kimlik Verisi kategorisinde değerlendirilen adınız, soyadınız, Fiziksel Mekân Güvenliği Verisi kategorisinde değerlendirilen, kamera kayıtlarınız, Maçka Residences binasına giriş-çıkış kayıtlarınız, Diğer Bilgiler kategorisinde değerlendirilen, ziyarete geldiğiniz firma/daire bilgisi;
6331 sayılı İş Sağlığı ve Güvenliği Kanunu ve ilgili mevzuat uyarınca çalışanlarımızın güvenliğini sağlama yükümlülüğümüzün yerine getirilebilmesi,
6331 sayılı İş Sağlığı ve Güvenliği Kanunu ve ilgili mevzuat uyarınca Maçka Residences binasının ve çevresinin güvenliğini sağlama yükümlülüğümüzün yerine getirilebilmesi,
Bina içerisine yapılan giriş ve çıkışların, adınız ve soyadınız ile eşleştirilerek kayıt altına alınıp kontrol edilebilmesi,
Bina içerisinde ziyaret gerçekleştirdiğiniz firma/daire ile iletişime geçerek ziyaretinize ait gerekli teyitlerin gerçekleştirilmesi,
Maçka Residences binası içerisindeki yetki sistemi ile çalışan asansörlerin kullanılabilmesi adına adınız ve soyadınıza ziyaretçi kartının zimmetlenebilmesi,
Müşterilerimiz, ziyaretçilerimiz, iş ortaklarımız veya tedarikçilerimiz gibi Maçka Residences binası içerisi ve çevresinde bulunan kişilerin güvenliğinin sağlanabilmesi,
Müşterilerimiz, ziyaretçilerimiz, iş ortaklarımız, tedarikçilerimiz veya çalışanlarımızın maddi ve manevi varlıklarına yönelik zarar verici hareketlere ilişkin talep ve şikayetlerin hızlı ve etkili bir şekilde yönetilebilmesi,
Müşterilerimizle olan ticari ilişkimizin tespit edilebilmesi,
Maçka Residences binasının ticari güvenliğinin temin edilebilmesi işleme amaçları dahilinde, KVKK’nın 5. maddesinde belirtilen;
Bina Yönetimi’nin hukuki yükümlülüğünün yerine getirilmesi için veri işlemenin zorunlu olması,
Bir hakkın tesisi, kullanılması veya korunması için veri işlemenin zorunlu olması,
Temel hak ve özgürlüklerinize zarar vermemek kaydıyla, Bina Yönetimi’nin meşru menfaatleri için veri işlemenin zorunlu olması
hukuki sebeplerine dayanarak işlenmektedir.
NOT: Maçka Residences binası içerisindeki yetki sistemi ile çalışan asansörlerin kullanılabilmesi adına adınız ve soyadınıza ziyaretçi kartının zimmetlenebilmesi amacıyla tarafımıza ibraz ettiğiniz kimlik kartınız içerisinde yer alan bilgilerinizden sadece ad ve soyad verileriniz Bina Yönetimi tarafından işlenmektedir. Fiziksel kimlik kartlarınız ise Bina Yönetimi tarafından gerekli tüm teknik ve idari tedbirler alınarak, tarafınıza vermiş olduğumuz ziyaretçi kartının iade edilmesi amacıyla talep edilmektedir.
Maçka Residences binası içerisinde yer alan CCTV vasıtasıyla elde ettiğimiz kişisel verileriniz sunucularımızda elde edilme anından itibaren 45 (Kırkbeş) gün boyunca saklanmakta ardından sistemden silinmektedir.
Yukarıda, toplama yöntemi ve hukuki sebebi ile işleme amacı belirtilen kişisel verileriniz;
İç işleyişimizi sağlamak, hizmetlerimizi geliştirmek, altyapı ve güvenlik süreçlerini geliştirmek ve aramızdaki operasyon sözleşmesinin gereklerinin yerine getirmek adına bağlı olduğumuz Astaş Turizm İşletmeciliği A.Ş.’ye
İş süreçlerimizi hukuka ve meşru menfaatlerimize uygun olarak yürütebilmek ve olası bir yargı sürecinde savunma hakkımızı kullanabilmek amacıyla; avukatlara, denetçilere ve danışmanlık hizmeti aldığımız diğer üçüncü kişilere,
Hukuki yükümlülüklerimizi yerine getirmek amacıyla; hukuka ve usule uygun olması koşuluyla düzenleyici ve denetleyici kurumlar ile mahkeme ve icra müdürlükleri gibi sair resmi kurumlara ve kişisel verilerinizi talep etmeye yetkili olan diğer kamu kurum ve kuruluşlarına,
Vekil ve temsilcilerinize ilettiğiniz taleplerinizin yerine getirilmesi amacıyla, tarafınızca yetki verilmiş vekil ve temsilcilerinize
KVKK’nın 8. maddesinde belirtilen kişisel veri işleme şartları ve amaçları çerçevesinde, ayrıca gerekmesi halinde açık rızanıza başvurularak aktarılabilecektir.
Kişisel verilerinizle ilgili olarak;
1) Kişisel verilerinizin işlenip işlenmediğini öğrenme, 2) Kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme,
3) Kişisel verilerinizin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
4) Kişisel verilerinizin yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme,
5) Kişisel verilerinizin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme,
6) KVKK’nın 7. maddesinde öngörülen şartlar çerçevesinde kişisel verilerin silinmesini veya yok edilmesini isteme,
7) (d) ve (e) bentleri uyarınca yapılan işlemlerin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
8) İşlenen verilerinizin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme,
9) Kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarar uğramanız halinde, zararınızın giderilmesini talep etme
haklarına sahipsiniz.
Belirtilen haklarınız kapsamında taleplerinizi, “Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ” uyarınca şahsen veya noter aracılığıyla yazılı olarak veya kayıtlı elektronik posta (KEP) adresi, güvenli elektronik imza, mobil imza ya da tarafınızca veri sorumlusuna daha önce bildirilen ve veri sorumlusunun sisteminde kayıtlı bulunan elektronik posta adresinizi kullanmak suretiyle iletebilirsiniz.
Başvurunuz KVKK'da öngörülen ilgili hükümler doğrultusunda cevaplandırılacak olup başvurucunun doğru kişi olduğunun teyit edilmesi amacıyla Bina Yönetimi sizden bazı doğrulayıcı bilgiler talep edebilecektir; bu bilgiler yalnızca gerçek veri sahibinin kim olduğunun tespit edilmesi ve başvuru sonuçlarının doğru kişiyle paylaşılması adına talep edilecektir.

PRIVACY NOTICE FOR VISITORS REGARDING THE CLOSED CIRCUIT TELEVISION SYSTEM
We, Maçka Residences Management (“Maçka Residences” or the “Building Management”) as a data controller with respect to processing of the personal data of all individuals available inside the building of Maçka Residences (“office/residence staff”) for fulfilment of business processes under the Personal Data Protection Law no. 6698 (the
“PDPL” or the “Law”) and relevant regulations and strive to protect the data processed hereunder by taking technical and administrative measures specified in the PDPL, secondary regulations enforced in line with the PDPL and binding decrees of the Personal Data Protection Board among others.
This notice is intended to provide detailed information about the processing of your personal data in order to comply with our obligation to inform data subjects pursuant to article 10 of the PDPL.
We shall process your name and surname which constitute Identification Data, your camera footage and your records of arrival to and departure from Maçka Residences building as part of Physical Space Safety Data, and the company/apartment you shall visit as part of Other Information which shall be obtained through closed circuit television system (“CCTV”) at the building of Maçka Residences and wholly automated methods with the use of your identification card to be submitted with a view to:
Fulfilling our obligation to ensure safety of our employees pursuant to the Occupational Health and Safety Code no. 6331 as well as relevant regulations,
Fulfilling our obligation to ensure safety of the building and periphery of Maçka Residences pursuant to the Occupational Health and Safety Code no. 6331 as well as relevant regulations,
Recording and controlling arrivals to and departures from the building by matching the records with your name and surname,
Contacting the company/apartment you intend to visit inside the building in order to receive confirmation about the visit,
Presenting a visitor card to enable you to use the elevators operated by means of the floor number authorization inside the building of Maçka Residences by registering the card in your name,
Promoting the safety of our customers, visitors, business partners, suppliers or other parties inside and around the building of Maçka Residences,
Handling the requests and complaints of our customers, visitors, business partners, suppliers or employees regarding pecuniary and non-pecuniary damages as swiftly and effectively as possible,
Determining our commercial relationship with our customers,
Promoting commercial safety of the building of Maçka Residences
in line with the legal provisions of article 5 of the PDPL to the extent data processing is legally required:
for the Building Management to fulfil its legal obligations,
to establish, exercise or protect any right,
to further its legitimate interests provided that any such processing shall not impair your fundamental rights and freedoms.
NOTE: Please note that the Building Management shall process solely your name and surname in the identity card which shall be presented to be issued a visitor card so that you may use the elevators operated by means of the floor number authorization inside the building of Maçka Residences. Your physical identity card, on the other hand, shall be received and kept by the Building Management until you return the visitor card provided that all kinds of technical and administrative measures shall be taken for ensuring the safety of the card.
The personal data to be obtained through the CCTV system inside the building of Maçka Residences shall be maintained for 45 (forty five) days from the time they are captured in our servers before they are deleted from the system.
Your personal data which shall be collected for the legal purposes provided above may be disclosed to:
Astaş Turizm İşletmeciliği A.Ş., the parent company, in order to conduct our internal operations, improve our services, infrastructure and safety processes, and fulfil the requirements of the operational agreement which is currently effective,
legal counsels, auditors and other third party advisors in order to conduct our business processes in line with the applicable laws and our legitimate interests and exercise our right to defence in case of any potential dispute,
regulatory and supervisory agencies, governmental organizations such as courts and bailiff’s offices and other public entities and organizations which are entitled to demand your personal data for the purposes of fulfilling our legal obligations to the extent that any such disclosure conforms to legal processes and practices,
your duly authorized attorneys and representatives in order to address your concerns which you may choose to inform us via your attorneys and representatives
in line with the personal data processing motives and conditions as provided in article 8 of the PDPL by receiving your explicit consent where necessary.
Regarding your personal data, you shall be entitled to;
1) learn whether or not your personal data have been processed, 2) request information concerning the processing, if applicable,
3) request information about the processing purpose and whether or not the use of the data is fit for the purpose,
4) receive information about the recipient domestic or foreign third parties, 5) ask for correction in case of incomplete or incorrect processing,
6) ask for deletion or destruction of your personal data under the conditions specified in article 7 of the PDPL,
7) demand notification of the relevant processes conducted as per paragraphs (d) and (e) above to the third persons who are known to have received the personal data by way of transfer,
8) object to any unfavourable result against you arising from analysis of processed data with automated systems exclusively,
9) demand indemnification against losses, if any, incurred as a result of processing activities in violation of the law.
Should you intend to exercise any of the rights listed above, please file an application in writing or through the use of registered electronic mail (KEP) address, secure electronic signature, mobile signature or electronic mail address duly informed to the data controller in line with the “Communiqué on Principles and Procedures Regarding Applications to Data Controllers”.
Your application shall be handled in line with the provisions of the PDPL in that you may be asked to provide additional information in order to help the Building Management make sure that the applicant is actually entitled to make the relevant request. Please note that the relevant information shall be required exclusively for the purpose of identifying the actual data subject and sharing the result with the correct person.
