REGULATION OF ANIMAL DISEASES TO BE DISCLAIMED AND NOTICE

• Purpose
• ARTICLE 1 - (1) The purpose of this Regulation is; The purpose of this study is to regulate the procedures and principles regarding the removal of the restrictions imposed on these diseases after the outbreak of mandatory animal diseases and the eradication of the last outbreak, except for the special provisions related to the studies on the eradication and / or prophylaxis of animal diseases.
Scope
ARTICLE 2 - (1) This Regulation covers the release of mandatory animal diseases and the abolition of restrictions on these diseases after eradication of the last outbreak.

ARTICLE 3 - (1) This Regulation;
a) Based on the subparagraph (d) and sixth paragraph of the first paragraph of Article 4 of the Law on Veterinary Services, Plant Health, Food and Feed No. 5996 dated 11/6/2010,
b) In accordance with the European Commission Decision 2005/176 / EC, which regulates the forms and codes prepared for the notification of animal diseases by the EU Council Directive 82/894 / EEC on the notification of animal diseases,

Definitions
ARTICLE 4 - (1) In this Regulation,
a) Ministry: Ministry of Agriculture and Rural Affairs,
b) Primary outbreak: the first outbreak in the country, which occurs in the same or a different region without the epidemiological connection,
c) Secondary outbreak: Other outbreaks of the same disease seen after the primary outbreak in the infected area,
ç) Operation: An agricultural or non-agricultural establishment or facility in which animals are raised or kept,
d) Alteration: the operation, settlement or area in which the animals or animals in which the existence of any of the diseases listed in Annex-1 are kept together; If the disease has been detected in the carcass, the plant where the carcass is obtained,
e) Official veterinarian: The veterinary staff of the Ministry, acting on behalf of the Ministry,
f) Case: official confirmation of any disease in Annex-1 in an animal or carcass,
g) Competent authority: Provincial and district directorates of the Ministry,

ARTICLE 5 - (1) The competent authorities, such as animal owners and carers, veterinarians and village headmen, village guards, lepers, shepherds, ship captains, station or customs officers or administrators who are aware of infectious animal disease or unexplained animal deaths, must notify.
(2) The official veterinarian shall make necessary notifications within 24 hours to the Ministry through the competent authority for the determination of the primary outbreaks of any disease in Annex-1 and the abolition of restrictions on these diseases after the eradication of the last outbreak. The official veterinarian shall notify the Ministry through the competent authority within 48 hours of the determination of the secondary outbreak of any disease in Annex-1. However, after the detection of primary and secondary outbreaks and the eradication of the final outbreak, the scope, content and frequency of the notifications to be made in order to remove the restrictions imposed on these diseases may be temporarily changed by the Ministry in the light of the disease, and in particular epidemiological developments.
(3) The Ministry shall make necessary notifications to the European Commission within 24 hours to determine the primary outbreak of any disease in Annex-1 and to remove restrictions on these diseases after the eradication of the last outbreak.
(4) The notification contained in the third paragraph covers the information described in Annex 2 and is made by one of the means of communication such as fax, e-mail.
(5) For the notification of disease to the European Commission, forms and codes prepared by the European Union for the notification of animal diseases are used.
(6) The Ministry shall notify the European Commission no later than the first working day of the week in relation to the identified secondary outbreak of any disease listed in Annex 1, with the exception of specific provisions relating to the studies on eradication and / or prophylaxis of animal diseases. The notification covers the week before Sunday, which ends at midnight.
(7) The fact that the Ministry did not notify the European Commission within the period specified in the sixth paragraph means that there were no secondary outbreaks within this period.(8) The identified cases of diseases in Annex-1 in animals shall be notified to the Ministry, but the disease shall not be released.
