AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF TURKEY AND THE GOVERNMENT OF THE KINGDOM OF SWEDEN

CONCERNING THE EMPLOYMENT OF TURKISH WORKERS IN SWEDEN

The Government of the Republic of Turkey and the Government of the Kingdom of Sweden,

Considering the friendly relations between the two countries and the mutual benefits of the exchange of labour,

Accepting that the employment of Turkish workers in Sweden shall be beneficial to both countries, Expressing the desire of reaching an agreement concerning the employment of Turkish workers in Sweden,

Have agreed as follows:

GENERAL PROVISIONS Article 1

1. The Swedish Labour Market Board (hereinafter called the Board) shall continuously supply the Turkish Labour Exchange (hereinafter called Kurum) with information on the need in Sweden of Turkish workers. The information given shall be split up into trades, industries and occupations.

Kurum shall inform the Board to what extent the need can be met.

2. Kurum will also continuously supply the Board with information on the numbers, ages and qualifications of the Turkish workers who wish to work in Sweden.

Article 2

The Board shall provide Kurum with necessary information on the general conditions of work and wages in Sweden, the general living conditions as well as the social benefits according to the legislation in force.

PROVISIONS CONCERNING EMPLOYMENT OF TURKISH WORKERS Article 3

The Board shall forward to Kurum offers of Swedish employers for employment in Sweden of Turkish workers. These offers will contain particulars on the locality where the work will be performed, the name and the address of the employers, nature and approximate length of the works offered wages and other employment conditions as well as board and lodging facilities.

Article 4

Kurum shall take the necessary measures for meeting the employment offers of Swedish employers.

Preselection of interested Turkish workers shall be effected by Kurum taking into account the requirements of each particular offer. The preselection shall include a medical examination as well as the issuance of health certificate and the establishing of professional skills and aptitude for the employment offered.

The Board shall not bear any costs for the abovementioned.

Article 5

The Board may establish an employment office in one or more places in Turkey after special agreement with Kurum. The office shall represent the Board in Turkey. It shall inform about the Swedish labour market and existing employment offers in Sweden and shall finally select those who will get employment in Sweden. The Board may also send temporary missions for the said purposes to Turkey.

Kurum shall free of cost provide the said office or offices with furnished office premises including telephone connection as well as put at their disposal necessary premises for medical and other examinations.

Furthermore, Kurum shall assist the office or offices in obtaining access to such services of hospitals, laboratories and x-ray equipment, as may be required by the said office or offices.

The Turkish workers shall appear before the office or the mission for final selection and they shall, on that occasion, apply for a Swedish residence and labour permit which shall be granted free of charge and in accordance with the existing visa agreement between Sweden and Turkey.

The Board shall not bear any costs for the appearance of the Turkish workers. However, the cost of medical and professional examination that may be required by the office in connection with its final selection shall be borne by the Board.

Article 6

The Turkish worker who has been selected for employment in Sweden and whose application for a residence and labour permit has been granted shall before his departure be given the necessary documentary evidence of such permits as well as a written statement by the Board containing the following information:

a) particulars as per Article 3,

b) an undertaking by the Board to advance the expenses covering the worker's travel from an appointed place in Turkey to the place of work in Sweden,

c) a guarantee by the Board that the worker shall be provided with board and lodging free of charge in Sweden until he commences the work that has been offered. If the wage -and other work- conditions are not the same as those of a Swedish worker the same guarantee shall apply until he has been offered another employment of a corresponding nature.

The worker shall guarantee to accept employment of the kind that has been offered to him in Turkey.

The form of reciprocal guarantees according to this article shall be established by an agreement between the Board and Kurum.

Article 7

Kurum shall, in accordance with the Turkish legislation in force, assist selected workers as well as their family members i. e. husband or wife, children and parents who accompany them or who intend to join them in Sweden, in obtaining without delay passport and other necessary documents.

These family members will be granted residence permits in accordance with the Swedish legislation in force and such permits shall be free of charge.

The travel of the Turkish workers to Sweden shall be arranged by the Swedish employment office concerned or the temporary mission in Turkey in cooperation with Kurum. Kurum shall see to it that workers will appear at the appointed place and hour of departure.

Article 8

The Contracting Parties shall take necessary steps in order to expedite and simplify administrative formalities in connection with the departure for, the travel to and the arrival in Sweden of workers having been selected in accordance with this agreement.

THE POSITION OF THE TURKISH WORKERS Article 9

The Turkish workers in Sweden shall be guaranteed the same treatment as Swedish workers as regards precautionary safety measures and conditions of hygiene at the place of work under the legislation in force.

As regards wage -and other work- conditions and employment contracts the Turkish worker shall be treated equally with a Swedish worker under the legislation and the collective agreements in force.

Article 10

The Turkish worker may during his stay in Sweden change employment. He shall also be allowed to transfer his savings to Turkey in accordance with the currency regulations in force in Sweden at the moment of transfer.

Article 11

A Turkish worker in Sweden who has become unemployed shall be given the same assistance by the labour exchange offices in Sweden as a Swedish worker.

If a Turkish worker has not become eligible for unemployment insurance benefit, or in other instances of need, necessary social assistance shall be extended to him in accordance with the legislation in force.

The Turkish workers in Sweden shall have access to vocational training in accordance with the Swedish labour market policy, on the same conditions as those which apply to Swedish workers and taking into account the places available for such training.

Vocational training and language courses for workers going to Sweden may by agreement between the competent Swedish and Turkish authorities be arranged in Turkey with the assistance of Swedish experts.

The expenses for the teachers and the material used in the training as well as for the board and lodging of the trainees during the training shall

be borne by the Swedish authorities.

FINAL CLAUSES Article 12

A commission composed of an equal number of representatives of the Contracting Parties shall, at the request of one of them, convene alternatively in Sweden and Turkey.

The purpose of the commission is to examine major difficulties that may arise in the application of this agreement and to submit proposals for their elimination.

Article 13

This Agreement shall enter into force on the date of signature.

Either of the Contracting Parties may terminate this Agreement at any time by giving six months notice to the other Party through the diplomatic channel.
