Doğuş Üniversitesi Hukuk Fakültesi tarafından düzenlenen Uluslararası Kamu Denetçiliği (Ombudsmanlık) Sempozyumu’na hoş geldiniz, bizi onurlandır-dınız.
Ülkemizin demokratikleşme süreci ivme kazanırken Ombudsmanlık-Kamu Denetçiliği mantık ve ruhunun kurumsallaşması gerekliliğinin bilinci çağcıl aydınların ve de özellikle çağcıl hukukçuların zihnindeydi. İdarenin eylem ve işlemlerinin, tutum ve davranışlarının yargı organının pozitif hukuka dayalı denetleme operasyonu üstünde adalete, hakkaniyete uygunluğunun değerlen-dirilmesi kamu vicdanının, vicdanların tatmini anlamına gelmektedir.
Böyle bir mekanizmayı Ahilik örgütlenmesi, Loncaların işleyişiyle Osmanlı’da görüyoruz. Söylenen odur ki, İsveç Kralı Demirbaş Şarl, Osmanlı Ülkesine geldiğinde bu sistemi incelemiş ve ülkesine döndüğünde benzer bir yapıyı oluşturmak istemiştir. Ondan takriben 80-90 yıl sonra İsveç’te kurumsallaşan Ombudsmanlık, zamanla tüm demokratik ülkelere örnek olmuştur.
Büyük Devlet Adamımız Bülent Ecevit’in büyük hülyalarından biri böyle bir kurumun Türk demokrasine getirilmesi idi. Demokrat ve de özellikle sosyal demokrat anlayış başka türlü düşünemez. Hak ve özgürlükler böylelikle ancak sağlam temellere oturabilir.
12 Eylül 2010 Referandumundan sonra Kamu Deneticiliği Kurumu artık Anaya-sal boyuta taşındı. Bugünlerde TBMM uyum yasasını müzakere sürecine girdi. Tüm bu gerekçelerden hareketle, Doğuş Üniversitesi Hukuk Fakültesi olarak bir sempozyum düzenlemeyi planladık. Konunun uzmanı olan akademisyen-lerle temasa geçtik. Uluslararası boyut için önce Ombudsmanlık kurumunun doğuş yeri olan İsveç’ten sayın Prof.Dr. Lotta Vahlne Westerhall’la temas
| 4 | Uluslararası Kamu Denetçiliği (Ombudsmanlık) Sempozyumu kurduk. Alman Trier Üniversitesi Hukuk Fakültesi öğretim üyesi aziz dostumuz Prof. Dr. Gerhard Robbers’i aradık. Türk hukukçu ve akademisyen dostların kabul buyurmalarıyla kadroyu tamamlamıştık. Ama Ombudsman eksikti. Sevgili hocam, Türk Anayasa Hukukunun duayeni Prof. Dr. Ergun Özbudun’un yönlendirmesiyle Avrupa Ombudsmanı Prof. Dr. Nikiforos Diamandouros ve Uluslararası Ombudsman Enstitüsü Başkanı Prof. Dr. Rafael Ribo’yu aradık. Hepsi lütfettiler, konuşma yapmayı kabul buyurdular.
Tasarı TBMM’nde iken Devlet ricalinin de Sempozyuma katılmasının gerekliliğini düşündük. Sayın dekanımız Prof. Dr. Fehim Üçışık’la Ankara yollarına koyulduk. T.C. Anayasa Mahkemesi Başkanımız Sayın Haşim Kılıç, Devlet Bakanı ve Başbakan Yardımcımız Sayın Bülent Arınç, TBMM İnsan Hakları Komisyonu Başkanı Prof. Dr. Zafer Üskül, Yargıtay Onursal Başkanı Prof. Dr. Sami Selçuk bizleri kırmadılar.
Böyle bir toplantının iletişim boyutu da vardı. RTÜK’ü ziyaret ettik. İki farklı siyasal eğilimi temsil eden iki değerli bilim insanı dostlar Prof. Dr. Hasan Tahsin Fendoğlu ve Prof. Dr. Korkmaz Alemdar’la siyasal objektiviteyi sağ-lamak istedik.

Welcome to the International Ombudsman Symposium which is organised by Dogus University, it is an honour for us hosting you all.
As the democratization process gained speed in our country, the need for the institutionalization of the sense and the spirit of the Ombudsman/ Government Auditor, was on the minds of modern thinkers, especially the ones concerning law. The inspection of the acts and proceedings of the government over the positive law, in terms of accordance to justice and the equity, means the satisfaction of the public conscious.
We see a similar mechanism in Ottoman through the Ahi community. It is reported that Charles XII, the King of Sweden, observed this system when he came to the Ottoman Empire and wanted to develop a similar system after arriving his country. The Ombudsman, institutionalising in Sweden almost 80 years later than the first studies, became a model to all of democratic countries.
Bringing such a democratic institution into the Turkish democracy was one of the dreams of the great Turkish politician Bülent Ecevit. The democrat and especially the social democrat concept can not be thought any other way. That is the only way to build the rights and the freedoms on solid bases. After the September 12, 2010 referendum, the Government Auditor Institution has become a constitutional concept. Grand National Assembly of Turkey is in the process of deliberation of adjustment law.
On account of all the reasons above, we, as the Law Faculty of Dogus University, organised this symposium. We contacted the academics who are the experts of the subject. For the international dimension, we contacted dear Prof. Dr. Lotta Vahlne Westerhall who is from the country of origin of
| 6 | Uluslararası Kamu Denetçiliği (Ombudsmanlık) Sempozyumu the institution. We called our dear friend, Prof. Dr. Gerhard Robbers, from Trier University in Germany. Everything was set when theTurkish academics kindly accepted our invitation, however we lacked the Ombudsman himself. With the guidance of the beloved professor, veteran of the Turkish constitutional law, we contacted Prof. Dr. Nikiforos Diamandouros, the European Ombudsman, and Prof. Dr. Rafael Ribo, the President of the International Ombudsman Institution. They all, so kindly, accepted to honour us here in this symposium.
We thought that it was important to have participants from the governmental level. Prof. Dr. Hasan Fehim Üçışık, the Dean of the Law Faculty of Dogus Universtiy, and myself went to Ankara in order to meet dear Haşim Kılıç, Constitutional Court President of Turkey; dear Bülent Arınç, Secretary of State and Deputy Prime Minister; Prof. Dr. Zafer Üskül, the President of the Grand National Assembly of Turkey’s Comission on Human Rights; Prof. Dr. Sami Selçuk, the Honorary President of the Court of Cassation. We are very grateful to them for accepting to be a part of this symposium. Unfortunately, some of them are not able to be here because of the weather conditions.
Also the symposium has a communication side to it. We visited The Supreme Board of Radio and Television. In order to see the issues in an objective way we invited, Prof. Dr. Hasan Tahsin Fendoğlu and Prof. Dr. Korkmaz Alemdar, two important scholars from different political tendencies.
Prof. Dr. Sibel İnceoğlu, Prof. Dr. Mustafa Koçak, Prof. Dr. Öner Eyrenci, Prof. Dr. İştar Gözaydın Savaşır, Assoc. Prof. Dr. Tahsin Erdinç and Assoc. Prof. Dr. Selman Karakul are all very important academics who contributed so much to the Symposium.
